1. Agreement to Terms
These Terms of Service ("Terms", "Terms and Conditions") govern your relationship with AtacamaInn.com website and the Atacama Inn hotel located in San Pedro de Atacama, Chile (the "Service") operated by Atacama Inn ("us", "we", or "our").
Please read these Terms and Conditions carefully before using our Service or making a reservation. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, guests, and others who access or use the Service.
2. Reservations and Bookings
When you make a reservation through our website, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate cancellation of your booking.
- Guest Age: The primary guest making the reservation must be at least 18 years of age. Valid government-issued photo identification is required upon check-in.
- Room Allocation: While we strive to honor specific room requests, room allocation is subject to availability at the time of check-in and cannot be guaranteed.
- Pricing: All prices are quoted in USD or Chilean Pesos (CLP) and are subject to change without notice. The price confirmed at the time of booking will be honored.
3. Payment and Cancellation Policy
3.1 Payments
A valid credit card is required to secure your reservation. Depending on the rate selected, we may pre-authorize your card or charge a deposit prior to your arrival. Full payment for your accommodation is typically required upon check-in or check-out, alongside any incidental charges incurred during your stay.
3.2 Cancellations and No-Shows
Our standard cancellation policy allows for free cancellation up to 14 days prior to your scheduled arrival date. Cancellations made within 14 days of arrival will incur a penalty equal to the first night's room rate plus applicable taxes. In the event of a "no-show," the total price of the reservation will be charged.
4. Hotel Policies and Guest Conduct
To ensure a pleasant, safe, and luxurious environment for all our guests, we enforce the following hotel rules:
- Check-in / Check-out: Standard check-in time is 3:00 PM local time. Check-out time is 11:00 AM. Late check-outs must be arranged in advance and may be subject to additional fees.
- Smoking: Atacama Inn is a strictly non-smoking property inside all guest rooms and public indoor areas. Smoking is only permitted in designated outdoor zones. A deep-cleaning fee will be charged for smoking in guest rooms.
- Pets: With the exception of certified service animals, pets are not allowed on the hotel premises to maintain a hypoallergenic environment for all guests.
- Damage to Property: Guests are liable for any damage howsoever caused to the allocated room, furnishings, or hotel premises by them or their party during their stay.
- Amenities Use: Access to the Spa, pool, and evening casino lounge is subject to availability and specific operating hours. Please note that entry to the casino lounge requires guests to be 18 years of age or older.
5. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Atacama Inn and its licensors. The Service is protected by copyright, trademark, and other laws of both Chile and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Atacama Inn.
6. Limitation of Liability
In no event shall Atacama Inn, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Chile, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
